These terms cover how you use our website, how we communicate with you by text message and email, and the limits of what those communications can do. Reading them takes a few minutes. The short version: we cannot bind, change, or cancel coverage by text, email, or voicemail. Coverage changes require confirmation from our office.

1. Agreement to These Terms

By using our website, submitting a form, requesting a quote, or exchanging text messages with us, you agree to these terms. If you do not agree, please contact our office by phone instead at 970.963.6161.

Martin Insurance Group is an independent insurance brokerage licensed in the State of Colorado. We represent you, not a single insurance carrier, and we place coverage with multiple carriers on your behalf. These terms apply to our personal lines, commercial lines, health, and group benefits services.

You must be at least 18 years old to request a quote, enter into a contract with us, or consent to receive text messages from us.

2. Coverage Is Not Bound by Text or Email

Read this part. No request to add, change, cancel, or reinstate coverage takes effect until a licensed member of our staff confirms it to you directly and the carrier accepts it. A text message, an email, a voicemail, or a message left with someone outside our office does not bind coverage.

Text and email are convenient, but they are not guaranteed delivery. Messages can be delayed, blocked, or filtered without either of us knowing. Time-sensitive requests should be made by phone.

If you need coverage in place by a specific date or time, call our office and get verbal confirmation. Examples of requests that require confirmation from us before they are effective:

  • Adding or removing a vehicle, driver, property, or piece of equipment
  • Increasing or decreasing limits, or changing deductibles
  • Adding an additional insured or certificate holder
  • Canceling or non-renewing a policy
  • Reinstating coverage after a lapse

Reporting a claim by text or email does not constitute notice to your carrier. Claims should be reported to us by phone, or directly to the carrier's claims line, so we can confirm the report was received.

3. Text Messaging Terms

Martin Insurance Group sends text messages to clients and prospective clients who have provided a mobile number and consented to receive them. Participation is voluntary. Consenting to text messages is not a condition of purchasing insurance from us.

What we text you about

  • Quote status, application follow-up, and information we need to finish a submission
  • Policy servicing, including renewals, changes, endorsements, and document requests
  • Billing reminders and lapse or cancellation notices from carriers
  • Claims coordination and adjuster follow-up
  • Open enrollment deadlines and health or group benefits scheduling
  • Appointment confirmations and scheduling
  • Occasional agency updates, including market conditions affecting your coverage

How you consent

You consent to receive text messages from us when you provide your mobile number on a quote request, application, service form, or website form that discloses text messaging, when you give your number to a member of our staff and agree to be texted, or when you text our number first.

Consent applies to the mobile number you provide. If your number changes or is reassigned, tell us so we do not text a number that is no longer yours.

Message frequency and cost

  • Message frequency varies based on your policies, your requests, and the time of year. Renewal and open enrollment periods generate more messages than the rest of the year.
  • Message and data rates may apply. Those charges come from your mobile carrier, not from us. Check your plan if you are unsure what texting costs you.

What not to send by text

Do not send Social Security numbers, driver's license numbers, financial account numbers, payment card numbers, or detailed health information by text. Text messaging is not a secure channel. If we need that information, we will give you a secure way to send it.

4. Opting Out and Getting Help

To stop messages: reply STOP to any text from us. You will receive one confirmation message and then no further texts from that number.

Opting out of text messages does not cancel your insurance and does not stop us from contacting you by phone, email, or mail. Some notices are required by law or by your carrier and will be delivered another way.

If you opt out and later want texts again, reply START or tell any member of our staff.

5. Carrier Disclosures

Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your device, your plan, network conditions, and carrier filtering.

Text messaging is supported on major U.S. wireless carriers. Availability on smaller regional and prepaid carriers can vary, which matters in parts of the Western Slope where coverage is inconsistent. If our messages are not reaching you, call us and we will use another method.

6. Quotes, Rates, and Coverage Information

A quote is an estimate, not an offer of coverage. Premiums and eligibility are set by the carrier and are subject to underwriting review, inspection, loss history, credit-based insurance scoring where permitted, and property or operations verification. Final terms can differ from a quoted figure, and a carrier can decline to write the risk.

Anything on this website describing coverage is a general summary. Your actual policy language, endorsements, exclusions, and limits control what is covered. If the two conflict, the policy controls. Read your policy and ask us about anything that is unclear.

We are not attorneys, accountants, or tax advisors. Nothing here is legal, tax, or financial advice.

7. Information You Provide to Us

You agree that the information you give us is accurate and complete to the best of your knowledge, and that you will tell us when it changes. Insurance applications are underwritten based on what you tell us.

Inaccurate or omitted information can cause a claim to be denied or a policy to be rescinded by the carrier, even after coverage has been in force. This includes items like undisclosed drivers, business operations not listed on an application, prior losses, and property conditions.

8. Website Use and Content

You may use this website for your own personal or business insurance needs. You may not use it to scrape data, submit false information, attempt unauthorized access, distribute malware, or interfere with its operation.

The content on this site, including text, layout, graphics, and the Martin Insurance Group name and logo, belongs to Martin Insurance Group and is protected by copyright and trademark law. You may print or save pages for your own reference. You may not republish or use our content commercially without written permission.

9. Third-Party Sites and Carrier Portals

We link to insurance carrier websites, payment portals, Connect for Health Colorado, and other outside resources. Those sites are operated by other companies under their own terms and privacy policies. We do not control them and are not responsible for their content, security, or availability.

Payments made directly to a carrier are governed by that carrier's terms. Posting time and processing are controlled by the carrier, not by us.

10. Disclaimers and Limitation of Liability

This website and our electronic communications are provided as is. We work to keep information current and accurate, but we do not warrant that the site will be uninterrupted, error free, or free of viruses, or that every page reflects the most recent change in insurance law or carrier practice.

To the fullest extent permitted by Colorado law, Martin Insurance Group is not liable for indirect, incidental, or consequential damages arising from your use of this website, from delayed or undelivered electronic messages, or from reliance on general coverage information published here rather than on your actual policy. Nothing in this section limits any obligation we owe you as a licensed insurance producer under Colorado law, and nothing here waives any right you have under that law.

11. Governing Law

These terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. Any dispute arising from these terms or from our services will be brought in the state or federal courts serving Garfield County, Colorado.

If any part of these terms is found unenforceable, the rest stays in effect.

12. Changes to These Terms

We may update these terms to reflect changes in our practices, our technology, or applicable law. The current version is always on this page with the date it was last updated. Continued use of our website or continued participation in our text messaging program after an update means you accept the revised terms.
